Delay in Start Up (DSU)
We are experts in forensic delay and timeline analysis. We utilise these skills to assess the delay or period of interruption caused by a property damage event.
We are uniquely placed to undertake a robust and verifiable analysis of any delay in start-up (DSU) or business interruption (BI) claim and make a fair and reasonable recommendation.
We will clearly communicate our opinion to all concerned, to ensure that where possible existing commercial relationships are maintained.
At Kenzie we use our extensive experience of construction, infrastructure, energy, power and renewables projects to ensure that we can support insurers, the insured and loss adjusters alike, should a claim be made under an insurance policy, and advise of the delay to completion or the start of commercial operations, caused by a property damage event.
Our expertise stems from working for contractors on live construction projects preparing and defending claims for delay and additional costs, which, coupled with our experience of working on insurance matters, has enabled us to have an invaluable insight into all the problems faced by projects of this nature.
When analysing a DSU claim, we will consider the effect of any uninsured events and how these may affect the indemnity claimed under the policy. The uninsured events that we will assess include:
- Project delays pre-property damage event
- The effect of mitigation and Increased Cost of Working (ICOW) measures
- The impact of float
- The impact of concurrent delays
- The effect of defect exclusions and LEG clauses contained within the Policy
Business Interruption (BI)
Our experts will objectively determine the reasonable time period required to complete the repair / reinstatement work, caused by the insurable event. During this process we will thoroughly analyse the proposed scope of work to determine, that the repair scope of work claimed, is in fact caused by the property damage event.
We will investigate and advise on the effectiveness of any mitigation strategies implemented to reduce the business downtime and mitigate the potential loss.
When analysing a BI claim, we will consider the effect of any uninsured events and how these may affect the indemnity claimed under the policy. The uninsured events that we will assess include:
- Duration of any planned turnaround or maintenance work
- The completion of any betterment or upgrade works
